Utilizing a statutory, case, and conceptual approach, it conducts normative legal research. The findings indicate that discretion can be categorized as a criminal act of corruption if it contradicts the intent behind its issuance, as outlined in Article 22 paragraph (2) of Law Number 30 of 2014 regarding Government Administration. Additionally, it must not fall within the parameters of discretion defined in Article 23 of the same law, fail to meet the necessary conditions for its issuance stated in Article 24, and align with the elements described in Article 3 of the Corruption Eradication Law, demonstrating an abuse of authority. Netralitas ASN menjadi prinsip penting dalam mewujudkan tata kelola pemerintahan yang transparan, akuntabel, dan profesional. Namun intervensi politik seringkali menjadikan birokrasi sebagai alat politik yang merugikan kualitas pelayanan publik dan kepercayaan publik. Penelitian ini bertujuan untuk menganalisis kerangka hukum dan peran kelembagaan pengawas dalam mencegah politisasi birokrasi di pemerintahan daerah. Metode yang digunakan adalah normatif, dengan analisis pendekatan Undang-Undang Nomor 5 Tahun 2014 tentang ASN, Peraturan Pemerintah Nomor 94 Tahun 2021, serta laporan lembaga pengawas seperti Komisi Aparatur Sipil Negara (KASN) dan Ombudsman RI. Hasil penelitian menunjukkan pelanggaran netralitas ASN terus meningkat akibat lemahnya pengawasan dan intervensi politik. Strategi penegakan peraturan, edukasi bagi ASN, dan penegakan hukum diperlukan untuk mencegah politisasi birokrasi. One of the characteristics in the life of indigenous peoples, especially the indigenous people of the Lamaholot tribe, is the customary judicial institution of the Lamaholot tribe. The purpose of this study is to determine and analyse the description of the Lamaholot customary judicial institution and the role of the Lamaholot customary judicial institution in resolving customary violations during murung keneber. This research is an empirical legal research with primary and secondary data. The data were collected through interviews and literature study. The results obtained are that there is a customary judicial institution of the Lamaholot tribe that has a role in resolving customary violations during murung keneber (planting season). This institution prioritises peace and recovery efforts (mela sare). The process of resolving customary violations through the Lamaholot customary justice institution is guided by Lamaholot customary law which still believes in the power of Dewa Rerawulan Tanaekan (God) and Ama Opo Koda Kewokot (ancestors). The settlement of customary violations through the Lamaholot customary judicial institution in Leworahang, Ile Padung Village is carried out by the belen suku onen (tribal chief) Raja Tuan who is the four major tribal parts in the Lamaholot tribe consisting of the koten, kelen, hurit and maran tribes, witnessed by belen suku onen from other tribes in the village/lewotana, and attended by ata nalan (the offending party). The Lamaholot customary justice institution plays a role in resolving customary offences. The settlement has a distinctive feature because the Lamaholot customary justice institution carries out the settlement of customary violations through traditional ceremonies (loge towe tonu wujo). It is expected that the indigenous people of the Lamaholot Tribe will maintain the characteristics of the Lamaholot Tribe's customary judicial institution so that it remains effective in resolving customary violations.</em></p> Mary Grace Megumi Maran Copyright (c) 2025 Mary Grace Megumi Maran https://creativecommons.org/licenses/by/4.0 2025-01-09 2025-01-09 6 1 10.22437/mendapo.v6i1.38556 The Legal Study of Land Redistribution Policy as Land Reform Object: State Administrative Law Perspective https://mail.online-journal.unja.ac.id/Mendapo/article/view/38322 <p><em>The land redistribution policy under land reform is a government effort to achieve equitable land ownership in the Unitary State of the Republic of Indonesia, as well as to improve the welfare of the Indonesian people. In practice, this policy often faces various legal and administrative challenges that can hinder its effectiveness. This study aims to analyze the mechanisms of administrative law in implementing the land redistribution policy under land reform, identify legal and administrative challenges encountered, and evaluate legal protections for beneficiaries in facing disputes or third-party claims. The method used in this research is a normative juridical approach with qualitative analysis techniques. The findings of this article indicate that the administrative law mechanisms in land redistribution still require improvement, particularly in inter-agency coordination and procedural transparency. Legal challenges include unsynchronized regulations, inadequate oversight, and budget limitations, while administrative obstacles relate to complex bureaucracy. Additionally, legal protections for beneficiaries remain suboptimal due to weak legal certainty regarding ownership status and potential conflicts with third parties. The conclusion of this article is that administrative procedure simplification and regulatory strengthening are necessary to ensure the effective implementation of the land redistribution policy. The recommendations provided in this article include enhancing coordination among relevant agencies, reforming the agrarian administration system, and providing stronger legal protection for beneficiaries to reduce potential disputes. The merit system, which focuses on individual qualifications, competencies and performance, offers a strategic approach to improving the professionalism, accountability and effectiveness of the state civil apparatus (ASN). However, the implementation of this system faces various challenges, including political intervention, nepotism, and low understanding of meritocracy. Through a state administrative law approach, this research analyzes the role of the merit system in bureaucratic reform, explores implementation challenges, and proposes strategic solutions. This research uses a literature review method by integrating various sources of law, government policies, and previous research. The results show that strengthening regulations, technology-based supervision, and socialization of meritocratic principles are important steps to overcome existing obstacles.
